Effective Date. The following terms of the Limited Warranty are effective as of April 3rd, 2025 (the “Effective Date”), as may be updated from time to time. Any future versions of the Limited Warranty shall indicate the date they went into effect.

The following terms of the Limited Warranty are supplement and are incorporated in all Work Authorization Agreements in which BEST STRUCTURE PRESERVATIONS, INC. is a Party (the “Agreement”). The Limited Warranty of BEST STRUCTURE PRESERVATIONS, INC., a California corporation (the “Company”, “we” “us” or “our”) is conditioned upon the Client’s agreement and compliance with all of the provisions contained within these terms. Any terms not defined herein shall have the meaning set forth in the Agreement.

We may amend the terms of the Limited Warranty at any time in our sole discretion, effective upon posting the amended terms of the Limited Warranty at https://www.buildbest.co/limitedwarrantyresources where the prior version of the terms of the Limited Warranty were posted. Any services completed by us pursuant to any Agreement between us and the Client will be governed by the version of the terms of the Limited Warranty effective at the time the Services were completed

THE CLIENT AGREES TO READ THE TERMS OF THE LIMITED WARRANTY IN THEIR ENTIRETY BEFORE ENTERING INTO ANY AGREEMENT WITH BEST STRUCTURE PRESERVATIONS, INC.

1. Issuance of Limited Warranty Certificate. Upon job completion and final inspection, the Company will issue a Limited Warranty Certificate to the Client. The Certificate shall specify the warranty duration, activation date, and any specific exclusions. The Company is responsible for completing this Certificate. The Limited Warranty becomes effective only upon issuance of this Certificate and is governed by the terms herein and the details included within the Certificate.

2. Warranty Coverage. All properly treated structural framing materials (‘Treated Materials’) are covered under a 15-year Limited Warranty, regardless of whether the treatment occurred during new construction or a remodel project, subject to the terms and conditions listed herein and in the Warranty Certificate.
To maintain warranty coverage, Clients must:
a. Schedule and complete annual inspections with the Company within forty-five (45) days of each anniversary of the warranty activation date;
b. Pay any associated annual inspection and renewal warranty fee as determined by the Company;
c. Remain in compliance with all provisions contained herein.
3. Termite Activity Disclaimer. Please note: Termite activity (e.g., swarming or sightings) may occur from time to time and does not indicate that treated structural framing is compromised. The treated materials remain protected, as the wood-destroying organism food source has been neutralized by the mineral preservative treatment.​
In the event termite activity is observed, we encourage Clients to contact us immediately. On-site visits are free of charge if the Client has paid their annual warranty fee.
In cases involving remodels, it is possible that termite activity may be more prevalent in areas where untreated wood was installed. These areas fall outside the scope of this warranty unless they were treated by the Company.
4. Limited Warranty. The Company provides a limited warranty to Client (the "Limited Warranty") that the Treated Materials shall be reasonably free from material structural damage caused by subterranean or drywood termites (“Material Damage”). The Client's approval or acceptance of the Treated Materials will not relieve the Company of its obligations under this Limited Warranty.

In the event that Treated Materials sustain Material Damage during the warranty period, the Company shall, at its option:​
a. Reapply the mineral preservative treatment to the affected Treated Materials; or
b. Reimburse the Client for actual labor and material costs reasonably incurred in repairing the damage.
Reimbursements shall not exceed the original Agreement amount. For example, if the Agreement total was $5,000.00, the maximum reimbursement will not exceed $5,000.00.

5. Limited Warranty Exclusions. This Limited Warranty does not cover:
a. Damage resulting from negligence, accidents, or willful acts by the Client or end-users, including but not limited to Conducive Conditions such as unaddressed moisture;
b. Any pre-existing infestations or damage present at the time of treatment;
c. Wood deemed inaccessible during the mineral preservative treatment;
d. Additional square footage or structural changes not treated by the Company;
e. Any other exclusions explicitly noted in the Warranty Certificate or Annual Warranty Inspection Form.
6. Warranty Claims. To initiate a claim, Client must email team@buildbest.co within thirty (30) days of discovering a suspected issue, and include the property address and description of the problem. Clients must preserve samples of the damaged area until either:
a. the Company advises in writing that the samples may be discarded; or
b. 60 days following the last date the Company reimburses the Client for the claim.
7. Duration & Termination. The Limited Warranty remains in effect for fifteen (15) years from the activation date listed in the Warranty Certificate, provided that:
a. Client complies with annual inspection and payment obligations;
b. No unauthorized alterations or untreated additions occur without disclosure;
c. Client adheres to all warranty obligations.
The Company may terminate this Limited Warranty with five (5) days’ written notice if violations occur. Termination applies prospectively only.
8. Client Obligations. Annual Inspections. Client agrees to schedule and complete inspections annually. During inspection, the Client must disclose:
a. Any new square footage or framing added since the last treatment or inspection;
b. Whether the additions were treated;
c. Any moisture or environmental concerns.
Authorized Applicators Only. Only certified Company applicators may administer treatments.
9. Transfer of Warranty. This Limited Warranty may be transferred to a new property owner upon the sale of the treated structure, provided that:
a. The new owner contacts the Company within sixty (60) days of property transfer to initiate warranty transfer procedures;
b. The new owner schedules and completes an annual inspection with the Company within forty-five (45) days of the anniversary of the original warranty activation date; and
c. The new owner pays all applicable inspection and warranty renewal fees.
The transfer does not extend the duration of the original warranty period. The warranty shall expire on the original expiration date listed in the Warranty Certificate unless otherwise agreed to in writing by the Company. Failure to meet the above conditions may result in termination of the Limited Warranty.
